제1장 총 칙

제1조 (목적)

이 규정은 한국도시철도학회(이하 ‘본 학회’)에서, 연구 및 논문출판에 대한 윤리를 확립하고, 논문출판 윤리성에 반하는 행위를 사전에 예방하며, 논문출판 윤리성에 반하는 행위 발생 시 공정하고 체계적인 윤리성 검증 및 조치를 위한 사항을 정함을 목적으로 한다.

제2조 (적용대상 및 범위)

이 규정은 본 학회에서 발간되는 논문집의 논문에 대하여 적용한다.

제3조 (용어의 정의)
  1. 1. 논문출판 윤리성에 반하는 행위(이하 ‘부당행위’)라 함은 논문의 발표 및 게재에서 행하여진 위조, 변조, 표절, 이중게재, 부당한 논문저자 표시 행위를 말한다. 구체적으로 부당행위는 다음 각 호와 같다.
    1. ① ‘위조’는 존재하지 않는 데이터 또는 연구결과 등을 허위로 만들어 내는 행위를 말한다.
    2. ② ‘변조’는 연구 재료·장비·과정 등을 인위적으로 조작하거나 데이터를 임의로 변형·삭제함으로써 논문 내용 또는 결과를 왜곡하는 행위를 말한다.
    3. ③ ‘표절’이라 함은 타인의 아이디어, 연구내용, 결과 등을 정당한 인용 없이 사용하는 행위를 말한다.
    4. ④ ‘이중게재’라 함은 이미 다른 학술지에 본인이 게재한 같은 언어로 된, 저작권을 명시한 논문의 상당부분을 있는 그대로 혹은 약간의 변형만을 가하여 명백한 인용이나 참조 없이 재사용하는 행위를 말한다. 단, 본 학회의 학술대회에 발표한 논문을 수정·보완하여, 본 학회논문집에 게재하는 경우는 이중게재로 보지 않는다.
    5. ⑤ ‘부당한 논문저자 표시’는 연구내용 또는 결과에 대하여 과학적·기술적 공헌 또는 기여를 한 사람에게 정당한 이유 없이 논문저자 자격을 부여하지 않거나, 과학적·기술적 공헌 또는 기여를 하지 않은 자에게 감사의 표시 또는 예우 등을 이유로 논문저자 자격을 부여하는 행위를 말한다.
  2. 2. ‘제보자’라 함은 부당행위를 인지하고 본 학회에 알린 자를 말한다.
  3. 3. ‘피조사자’라 함은 제보 또는 본 학회의 인지에 의하여 부당행위의 조사 대상이 된 자를 말하며, 조사과정에서의 참고인이나 증인은 이에 포함되지 아니한다.
  4. 4. ‘예비조사’라 함은 부당행위의 혐의에 대하여 공식적으로 조사할 필요가 있는지 여부를 결정하기 위한 절차를 말한다.
  5. 5. ‘본조사’라 함은 부당행위의 혐의에 대한 사실 여부를 입증하기 위한 절차를 말한다.
  6. 6. ‘판정’이라 함은 조사결과를 확정하고 이를 제보자와 피조사자에게 문서로서 통보하는 절차를 말한다.
  7. 7. ‘시효기산일’이라 함은 해당 부당행위가 이루어진 논문이 게재된 날을 의미하며, 동일 논문이 여러 번에 걸쳐 부정행위와 관련된 경우, 가장 최근의 게재일이 시효기산일이 된다.

제2장 저자, 심사위원, 편집위원의 윤리 규정

제4조 (저자의 윤리 규정)

투고논문의 저자는 논문의 작성과 제출에 있어 다음과 같은 윤리규정을 준수하여야 한다.

  1. 1. 투고논문의 연구 수행과정에서 저자는 인권존중, 인류복지증진 및 환경보호 등의 보편성을 확보하여야 한다.
  2. 2. 저자는 투고논문에서, 부당행위 없이, 연구내용을 정확하게 기술하여야 하고, 연구결과를 왜곡하지 말아야 한다. 투고논문은 기존 출판된 논문의 내용을 개선하거나, 기존 출판과 다른 새로운 내용을 포함하고 있어야 한다.
  3. 3. 논문 작성에 사용된 참고문헌은 보편적으로 알려진 것을 제외하고는 모두 인용하여야 하고, 그 출처를 명백하게 밝혀야 한다.
  4. 4. 투고논문의 연구 수행과정에서 기여한 모든 연구자는 공저자로 표기 되어야 하고, 기여가 없거나 미미한 자를 연구 외적인 이유로 공저자에 포함시키지 않아야 한다. 공저자의 기재 순서는 기여도에 따라 결정한다. 재정적 지원, 행정적 도움, 단순한 학술적 조언 등은 후기 (또는 감사의 글)에 표시하는 것이 바람직하다.
  5. 5. 저작권이 있는 자료를 투고논문에 사용할 경우에는 최종 출판 전에 저작권 사용허가를 득하고 이를 본 학회에 제출하여야 한다.
  6. 6. 투고 또는 출판 후 논문에서 오류가 발견될 경우, 저자는 이를 수정하거나 그 사안이 중대한 경우 투고 또는 출판된 논문을 철회하여야 한다.
  7. 7. 저자는 심사 완료 후 출판을 위한 최종 논문을 제출할 때, KCI 논문유사도 검사결과와 저자의 논문윤리준수확인서를 함께 학회로 제출하여야 한다.
제5조 (심사위원의 윤리 규정)

심사위원은 다음의 윤리규정을 준수하여 투고된 논문을 심사하여야 한다.

  1. 1. 심사위원은 저자의 성별, 나이, 인종, 소속기관 또는 저자와의 개인적 친분 등에 따른 편견 없이 심사논문을 일관된 기준으로 공정하고 객관적으로 심사하여야 한다.
  2. 2. 심사위원은 심사논문에 대한 비밀을 보장하기 위해 심사과정에서 취득한 정보를 다른 사람에게 공개하거나 유용하지 않아야 한다.
  3. 3. 심사위원은 전문 지식인으로서의 저자의 인격을 존중하여야 한다. 개인적이고 주관적인 평가나 불쾌한 표현을 자제하고 학문적으로 겸손한 자세에서 객관적인 심사의견서를 작성하도록 노력하여야 한다.
  4. 4. 심사위원이 논문 투고자와 동일기관 소속이거나, 의뢰된 논문과 직접적인 이해관계가 있는 경우에는 지체없이 담당 편집위원에게 그 사실을 통보하여 다른 심사위원을 선정할 수 있도록 하여야 한다.
제6조 (편집위원의 윤리규정)

편집위원은 다음의 윤리규정을 준수하여 투고논문에 대한 심사 및 판정업무를 수행하여야 한다.

  1. 1. 편집위원은 저자의 성별, 나이, 인종, 소속기관 또는 저자와의 개인적 친분 등에 따른 편견 없이 심사논문에 대한 판정업무를 정해진 규정에 따라 공정하고 객관적으로 수행하여야 한다.
  2. 2. 편집위원은 심사위원을 선정할 때, 투고자와 동일기관 소속자이거나 논문의 직접적인 이해 관계자는 배제하여야 한다.
  3. 3. 편집위원은 투고된 논문에 대한 심사위원의 심사결과를 바탕으로 일관된 기준으로 논문의 재심 여부나 게재 여부를 결정하여야 한다.
  4. 4. 편집위원은 심사과정에서 취득한 정보를 다른 사람에게 공개하거나 유용하지 않아야 한다.
  5. 5. 심사 완료 후 출판을 위해 제출한 최종본 논문과 저자가 제출한 KCI 논문유사도 검사 결과를 비교하여 편집위원은 최종본 논문의 출판 여부를 결정한다.
  6. 6. 편집위원은 저자와 심사위원 간의 비윤리적인 행위를 감시할 의무를 가지며, 비윤리적인 행위가 발견될 경우 이를 지체 없이 편집장에게 보고하여 조사와 함께 필요에 따라 적절한 징계가 이루어질 수 있도록 하여야 한다.

제3장 연구출판윤리위원회의 설치 및 운영

제7조 (기능)

연구출판윤리위원회(이하 ‘위원회’)는 논문의 윤리성을 확보하기 위한 다음 각 항의 사항을 심의·의결한다.

  1. 1. 논문출판윤리관련 제도의 수립 및 운영에 관한 사항
  2. 2. 부당행위 제보 접수 및 조사위원회의 구성과 조사위원의 위촉에 관한 사항
  3. 3. 예비조사와 본조사의 착수
  4. 4. 제보자 보호 및 피조사자 명예회복 조치에 관한 사항
  5. 5. 예비조사 및 본조사 결과의 처리 및 후속조치에 관한 사항
  6. 6. 기타 위원장이 부의하는 사항
제8조 (구성)

위원회는 문제시되는 논문이 있을 시에 위원장 1인과 5인 이내의 위원으로 구성하며, 위원장은 학회회장으로 하며, 위원은 위원장이 추천하여 이사회에서 승인한다.

제9조 (위원장)

위원장은 위원회를 대표하며, 회의를 소집하고 주재한다.

제10조 (간사)

위원회의 사무를 처리하기 위하여 위원회에 간사 1인을 두되, 총무이사로 한다.

제11조 (회의)
  1. 1. 위원장은 위원회의 회의를 소집하고 그 의장이 된다.
  2. 2. 회의는 재적위원 과반수 이상의 출석과 출석위원 2분의 1을 초과하는 찬성으로 의결하되, 제4조에 의해 구성된 조사위원회에 의해 확인된 부당행위에 따른 징계요구에 대한 결의는 출석위원 3분의 2 이상의 찬성으로 의결한다.
  3. 3. 위원장은 심의안건이 경미하다고 인정할 때에는 서면심의에 부의할 수 있다.

제4장 논문출판윤리성 검증

제12조 (부당행위 제보 및 접수)

위원회의 간사는 서면·전화·전자우편 등 가능한 모든 방법으로 제보를 받을 수 있으며 실명으로 제보를 받는 것을 원칙으로 한다. 단, 익명으로 제보를 받을 경우 서면 또는 전자우편으로 논문명 및 구체적인 부당행위의 내용과 증거를 받도록 노력한다.

제13조 (예비조사의 기간 및 방법)
  1. 1. 예비조사는 신고접수일로부터 15일 이내에 착수하고, 조사시작일로부터 30일 이내에 완료하여 위원회의 승인을 받도록 한다.
  2. 2. 예비조사에서는 다음 각 호의 사항에 대한 검토를 실시하여 본 조사를 실시할 필요성이 있는지 판단한다.
    1. ① 제보내용이 그 자체로 제3조 제1항의 부당행위에 해당하는지 여부
    2. ② 제보내용이 진실 여부에 대한 조사가 가능하도록 구체성과 명확성을 갖추고 있는지 여부
    3. ③ 제보일이 시효기산일로부터 5년을 경과하였는지 여부
  3. 3. 예비조사는 간사 주관 하에 본 학회 사무국에서 담당하되, 제보자에게 추가로 정보를 요청함은 물론 필요한 경우 관련 전문가들에게 조사를 의뢰할 수 있다.
제14조 (예비조사 결과의 통보)
  1. 1. 예비조사 결과는 위원장의 승인을 받은 후 10일 이내에 제보자에게 문서로 통보하도록 한다. 다만 제보자가 익명인 경우에는 그렇지 아니하다.
  2. 2. 예비조사 결과보고서에는 다음 각 호의 내용이 포함되어야 한다.
    1. ① 제보의 구체적인 내용
    2. ② 조사의 대상이 된 부당행위 혐의 및 관련 논문에 대한 설명
    3. ③ 본 조사 실시 여부에 대한 권고 및 판단의 근거
    4. ④ 기타 관련 증거 자료
제15조 (본 조사 착수 및 기간)
  1. 1. 본 조사는 위원장의 예비조사결과 승인 후 30일 이내에 착수한다. 본 조사는 판정을 포함하여 조사시작일로부터 90일 이내에 완료하도록 한다.
  2. 2. 위원회가 제1항의 기간 내에 조사를 완료할 수 없다고 판단될 경우 60일 이내에 기간연장 할 수 있다.
제16조 (자료제출 요구) 위원회는 제보자·피조사자·증인 및 참고인에 대하여 추가 자료제출을 요구할 수 있으며, 이 경우 피조사자는 반드시 응하여야 한다.
제17조 (제보자와 피조사자의 권리 보호 및 비밀엄수)
  1. 1. 어떠한 경우에도 제보자의 신원을 직·간접적으로 노출시켜서는 아니 되며, 제보자의 성명은 반드시 필요한 경우가 아니면 제보자 보호 차원에서 조사결과보고서에 포함하지 아니 한다.
  2. 2. 부당행위 여부에 대한 검증이 완료될 때까지 어떠한 경우에도 피조사자의 신원 또는 피조사자가 조사받고 있다는 사실을 위원회와 조사위원회 외부에 노출시켜서는 아니 되며, 이 밖에도 피조사자의 명예나 권리가 침해되지 않도록 주의하여야 하며, 무혐의로 판명된 피조사자의 명예회복을 위해 노력하여야 한다.
  3. 3. 제보·조사·심의·의결 및 건의조치 등 조사와 관련된 일체의 사항은 비밀로 하며, 조사에 직·간접적으로 참여한 자는 조사 및 직무수행 과정에서 취득한 모든 정보에 대하여 누설하여서는 아니 된다. 다만 합당한 공개의 필요성이 있는 경우 위원회의 의결을 거쳐 공개할 수 있다.
제18조 (이의제기 및 변론의 권리 보장)

위원회는 간사와 피조사자에게 의견진술, 이의제기 및 변론의 권리와 기회를 동등하게 보장하여야 하며 관련 절차를 사전에 알려주어야 한다.

제19조 (판정)
  1. 1. 위원회는 이의제기 또는 변론의 내용을 토대로 조사내용 및 결과를 확정하고 이를 제보자와 피조사자에게 통보한다.
  2. 2. 조사내용 및 결과에 대한 합의가 이루어지지 않을 경우 표결로 결정할 수 있으며 이 경우 재적위원 과반수 이상의 출석 및 출석위원 3분의 2 이상의 찬성으로 의결한다.
  3. 3. 제보자 혹은 피조사자가 위원회의 조사결과에 불복할 경우, 결과를 통지받은 날로부터 15일 이내에 해당 사유를 기재한 소명서를 위원회에 제출하여 재심의를 요청할 수 있다. 소명서의 타당성 검토 및 재심의 여부의 판단은 위원회가 소명서 수리 후 15일 안에 결정하며, 재심의를 하기로 결정한 경우 15일 안에 같은 윤리위원회를 다시 소집하거나 새로운 윤리위원회를 소집할 수 있다. 재심의가 결정될 경우 재심을 맡은 윤리위원회는 이의가 제기된 사항에 대해 윤리위원회 소집 후 30일 내에 재조사하고 결과를 확정하여 제보자와 피조사자에게 통보한다.
제20조 (본조사결과보고서의 제출)
  1. 1. 윤리위원회는 최종 판정 후 10일 이내에 본조사결과보고서(이하 ‘결과보고서’)를 제출하여야 한다.
  2. 2. 결과보고서에는 다음 각 호의 사항이 포함되어야 한다.
    1. ① 제보의 구체적인 내용
    2. ② 조사의 대상이 된 부당행위 혐의 및 관련 논문
    3. ③ 해당 논문에서의 피조사자의 역할과 혐의의 사실 여부
    4. ④ 관련 증거
    5. ⑤ 조사결과에 대한 제보자와 피조사자의 이의제기 또는 변론 내용과 그에 대한 처리결과
    6. ⑥ 조사위원 명단

제5장 검증 이후의 조치

제21조 (결과에 대한 조치)
  1. 1. 부당행위 관련자에 대해 위원회는 재적위원 과반수 이상의 출석 및 출석위원 3분의 2이상의 찬성이 있을 경우, 본 학회장에게 징계조치를 건의할 수 있다.
  2. 2. 학회장은 적절한 징계조치를 결정하고 해당 저자에게 조치사항을 서면으로 통지한다.
제22조 (징계조치)

학회장은 위원회의 징계건의가 있을 경우 다음 각 항을 참고하여 징계조치 수위를 정하여 징계조치를 취한다. 다음 각 항보다 더욱 적절한 징계조치가 있다고 판단되면 그에 따를 수도 있다.

  1. 1. (주의) 해당 논문의 모든 저자에게 부당행위에 관한 사실을 알리고, 향후 논문의 작성 시에 주의하도록 조치한다.
  2. 2. (경고) 해당 논문의 모든 저자에게 부당행위에 관한 사실을 알리고, 기 게재된 논문을 철회하며, 향후 논문의 작성시에 주의하도록 경고한다.
  3. 3. (문책) 해당 논문의 모든 저자에게 부당행위에 관한 사실을 알리고, 기 게재된 논문을 철회하며, 이를 학회의 Homepage 게시판에 1개월 동안 게시한다. 또한 현재 본 학회에서 부정행위 저자들의 심사 중인 모든 논문 및 게재를 위해 대기 중인 모든 논문을 취소한다. 그리고 해당 논문의 주저자는 3년 동안 본 학회에 논문을 제출할 수 없다.
  4. 4. (엄중문책) 해당 논문의 모든 저자들의 소속 기관장 및 저자들에게 이 사실을 공문으로 통보한다. 그리고 기 게재된 논문을 철회하고, 이를 학회의 Homepage에 1개월 동안 게시한다. 또한 현재 본 학회에서 부정행위 저자들의 심사 중인 모든 논문 및 게재를 위해 대기 중인 모든 논문을 취소한다. 그리고 해당 논문의 모든 저자들은 3년 동안 본 학회에 논문을 제출할 수 없다. 논문 표절의 경우, 위의 조치 후에 학회장은 원 논문의 저자들에게 사과의 공문을 발송한다.
제23조 (기록의 보관 및 공개)
  1. 1. 예비조사 및 본 조사와 관련된 기록 및 징계조치에 관한 기록은 학회 사무국에서 보관하며, 종료 이후 5년간 보관하여야 한다.
  2. 2. 최종보고서는 판정이 끝난 이후에 공개할 수 있으나, 제보자·조사위원·증인·참고인·자문에 참여한 자의 명단 등 신원과 관련된 정보에 대해서는 당사자에게 불이익을 줄 가능성이 있을 경우 공개대상에서 제외할 수 있다.
제24조 (운영세칙)

기타, 위원회 운영에 필요한 세부사항은 위원회의 심의를 거쳐 따로 정할 수 있다.

부 칙 1. 본 규정은 2013년 6월 1일부터 효력을 발생한다.

Ethical Regulations on Research Publications of KOSUR

Chapter 1. General Provisions

Article 1 (Purpose)

The purpose of these regulations is to establish and clearly define the ethical code to be adhered to by authors and journal editors and staffs for the publications of the Korean Society for Urban Railway (KOSUR; referred to as “the Society” hereafter), and to ensure fair and systematic resolution when unethical behavior is suspected or occurred.

Article 2 (Subject and Range of Application)

These regulations apply for all the submitted papers and published papers in the journals of the Society.

Article 3 (Definition of Terms)
  1. 1. Acts against ethical conduct related to research publications (referred to as “misconducts” hereafter) include forgeries, alterations, plagiarisms, dual-publications, and false representation of the authors who contributed to the research and writing of the paper. More details on these misconducts are as follows:
    1. ① ‘Forgery’ is the falsification of data or research results.
    2. ② ‘Alteration’ is the distortion of experimental results or other contents by manipulating research materials, equipments, and experimental processes, or by arbitrarily altering or deleting data.
    3. ③ ‘Plagiarism’ is the practice of using or copying someone else’s idea, research content or results without proper consent or credit.
    4. ④ ‘Dual-publication’ is the practice of reusing a significant amount of one’s own paper published (and copyrighted) in another journal as is or with only slight modification to the original language, and without any obvious quotation or reference to the previously published work. However, the Society journal paper publications of the Society conference papers after revisions are allowed, and not considered as dual-publications.
    5. ⑤ ‘False representation of authors’ is the failure to credit someone, without a valid reason, who made a scientific or technical contribution to the content or result of a submitted paper, or the granting of author credit to someone who did not make a scientific or technical contribution, even as a mark of appreciation or respect.
  2. 2. An ‘informant’ refers to a person who recognizes and reports any misconduct to the Society.
  3. 3. An ‘examinee’ refers to a person who is under investigation for misconduct according to the report of an informant or the Society’s recognition. A testifier or witness shall not be called an examinee.
  4. 4. A ‘preliminary investigation’ refers to a procedure by which the necessity of an official investigation on the suspicion of misconduct is determined.
  5. 5. An ‘official investigation’ refers to a procedure collecting facts to determine if misconduct has been committed.
  6. 6. ‘Judgment’ refers to a procedure of making decision based on the investigation. The informant and examinee are officially notified of the outcome of the judgment.
  7. 7. The ‘misconduct accrual date’ is the date on which the paper guilty of misconduct was first published. If the same paper is involved in misconduct multiple times, then the most recent date is the misconduct accrual date.

Chapter 2. Ethics for Authors, Reviewers, and Editors

Article 4 (Ethics Codes for Authors)

An author who submits a manuscript is required to comply with the following ethics codes in writing and submitting a paper:

  1. 1. The author must secure universality in respect for human rights, welfare of mankind, and protection of the environment.
  2. 2. The author must precisely elaborate on the research content without misconducts, and should not distort the research results. The manuscript must include a new result or an improved result compared to the contents of published papers or articles.
  3. 3. All documents (except the ones that are well known as common sense) which are related to the research content or may help its understanding must be included in the reference list, and cited in the main texts of the paper.
  4. 4. All the researchers who contributed to the research paper must be listed as co-authors in the paper, and the one who does not contribute substantially to the research must not be included in the author list by nonacademic reason. The order of authors in the author list is determined by the level of contribution. Financial support, administrative help, and simple academic advice are recommended to be acknowledged in an "Acknowledgements" section.
  5. 5. When the author want to include figures, tables, or text passages that have already been published elsewhere with copyright, the author is required to obtain permission from the copyright holder before publishing the paper, and submit the permission documents to the Society.
  6. 6. If an error is detected in the research paper during reviewing process or after publication, the author must revise it. If it is a serious error, the author must withdraw the submitted paper or published paper.
  7. 7. The author must submit KCI plagiarism checker result and signed confirmation of ethical conduct together with the final manuscript to the Society after the manuscript is accepted for publication.
Article 5 (Ethics Codes for Reviewers)

The reviewers are required to comply with the following ethics codes while the paper is under review for publication:

  1. 1. The reviewers must review the manuscript on a consistent, fair, and objective basis regardless of the author's gender, age, affiliation, or personal acquaintances, etc.
  2. 2. The reviewers must keep confidential on the information acquired during the review process, and should neither release the information to others nor misuse it.
  3. 3. The reviewers must respect the author as a professional intellectual. The reviewers must refrain from making subjective valuations and offensive expressions, and make efforts in writing objective review responses in an scholastically humble attitude.
  4. 4. If the reviewer is affiliated at the same institution with a author, or is directly related to the benefit of the paper, the reviewer must inform this fact to the editor immediately and make the editor to select other reviewer.
Article 6 (Ethics Codes for Editors)

The editors are required to comply with the following ethics code in the review and judgement of the research paper for publication:

  1. 1. The editor must convey a fair and objective judgement regardless of the author's gender, age, affiliation, or personal acquaintances, etc.
  2. 2. When the editor selects reviewers, he must exclude the researcher who is affiliated at the same institution with a author, or who is directly related to the benefit of the paper.
  3. 3. Based on the evaluations from the reviewers, the editor must apply consistent standards in the decision of which research paper to reexamine or publish.
  4. 4. The editor is not allowed to release or misuse the information acquired during the review process.
  5. 5. The editor make a final decision on the publication of the final manuscript after examining KCI plagiarism checker result that the author submitted.
  6. 6. The editor has the responsibility to monitor unethical behaviors between the reviewer and author. If such behaviors were detected, those should be immediately reported to the editor-in-chief for an investigation and appropriate punishments as necessary.

Chapter 3. Establishment and Management of Research Ethics Committee

Article 7 (Function)

The Research Ethics Committee of the Society ('Committee' hereafter) deals with and determines the following matters to obtain the publication ethics of research of the Society.

  1. 1. Establishment and management of the system related to the publication ethics of research.
  2. 2. Reception of reports on misconducts, organization of an Investigation Committee and appointment of investigators
  3. 3. Starting of the preliminary investigation and official investigation
  4. 4. Protection of the informant and redemption of the examinee’s honor where applicable
  5. 5. Handling of preliminary investigation results, official investigation results and follow-up actions
  6. 6. Handling of any other matters that the Chief Commissioner may present for consideration
Article 8 (Composition)

The Committee is organized with one Chief Commissioner and five (or less) members when there is a report of misconduct. The Chief Commissioner is the President of the Society. The Chief Commissioner nominates committee members and the Board of Directors approves them.

Article 9 (Chief Commissioner)

The Chief Commissioner represents the committee and organizes and presides over each meeting.

Article 10 (Assistant Administrator)

To handle certain business related to publication ethics, the Director of the General Affairs of the Society may act as an Assistant Administrator for the committee.

Article 11 (Meeting Procedure)
  1. 1. The Chief Commissioner organizes each meeting of the committee and presides over the meeting as the Chairman.
  2. 2. A meeting must be held with a half of the Committee members in attendance and any issue must be decided by favorable majority votes (at least a half) of the attending members. The decision regarding the request of a disciplinary action for misconduct confirmed by the Investigation Committee organized according to Article 4 requires a favorable vote of at least 2/3 of the attending members.
  3. 3. In the event of a minor issue, the Chief Commissioner can deliberate and decide based on his/her review of relevant documentation.

Chapter 4. Verification of the Ethicality of Research Publication

Article 12 (Reception of Misconduct Report)

The Assistant Administrator of the Committee can receive a report of misconduct by any means including but not limited to letter, telephone, and email, and generally receives the report under the name of the informant. When receiving a report anonymously, the Assistant Administrator endeavors to collect detailed information about the paper, including the title, and proof of misconduct.

Article 13 (Period and Method of Preliminary Investigation)
  1. 1. A preliminary investigation is initiated within fifteen (15) days of the initial reception of a misconduct report. The investigation and the committee’s approval of any findings are completed within 30 days of the start of the investigation.
  2. 2. The necessity of an official investigation is determined by the Committee after reviewing the following matters during the preliminary investigation.
    1. ① The report, itself, corresponds to ethical misconduct as described in Article 3, Clause 1 of the Ethical Regulations.
    2. ② The report contains concrete, clear and accurate information pertaining to the reported misconduct in order for investigation.
    3. ③ The report should be filed within five (5) years of the misconduct accrual date.
  3. 3. The Editorial Office is in charge of the preliminary investigation and is able to request additional information from the informant and support from relevant experts if necessary.
Article 14 (Notice of Preliminary Investigation Result)
  1. 1. The informant is notified of the result of the preliminary investigation within ten (10) days after the findings are approved by the Chief Commissioner. In the case of an anonymous informant, the result is not shared.
  2. 2. The preliminary investigation report should include the following contents:
    1. ① Detailed contents of the misconduct report
    2. ② Explanation of the misconduct in the paper under investigation
    3. ③ Reasons for the decision to perform the official investigation
    4. ④ Other relevant evidences if any.
Article 15 (Initiation and Period of Official Investigation)
  1. 1. An official investigation is initiated within 30 days after the Chief Commissioner’s approval based on the result of the preliminary investigation. The official investigation, including adjudication, is completed within 90 days of the date of investigation initiation.
  2. 2. If the Committee decides that they are unable to finish the official investigation within the period stated in Clause 1 (above), the investigation can be extended by 60 days.
Article 16 (Request for Materials)

The Committee can request additional information from the informant, examinee, or other any other witness. The examinee must comply with the request.

Article 17 (Confidentiality and Protection of Informant and Examinee)
  1. 1. Identification of the informant should not be exposed directly or indirectly under any circumstance, and, unless necessary, should not be included on the investigation report.
  2. 2. Neither the identity of the examinee, nor the fact that the examinee is being investigated, should be exposed outside of the Committee and the Investigation Committee until the misconduct investigation is completed. The examinee’s honor and rights should not be infringed upon. Also, the Committee should make every effort to redeem the damaged reputation of an examinee once free from suspicion.
  3. 3. All information regarding the initial report, investigation, deliberation, decision and proposed measures for resolution should be in confidence and any direct or indirect participants of the investigation should not reveal information acknowledged during the investigation and during the performance of one’s duties. In the event that reasonable exposure is necessary, the release of information must go to a committee vote.
Article 18 (Guarantee of Right to Objection and Defense)

The Committee should guarantee equal rights to all parties involved and the opportunity for statements of opinion, objection and defense. All parties involved should be informed of the related procedures in advance.

Article 19 (Judgment)
  1. 1. The Committee must come to a conclusion based on the investigations and with respect to any objections and defenses presented. The informant and examinee must be notified of the resulting decision.
  2. 2. If the committee cannot come to a consensus, the outcome must be decided by a vote. In this case, at least a half of the committee members must attend and at least 2/3 of the attending members must agree.
  3. 3. If either the informant or the examinee disagree with the decision of the Committee, an appeal stating valid reasons for objection and a request for a retrial can be submitted to the Committee within 15 days of the date on which the committee’s decision was made available. The appeal’s validity and the granting of a retrial are decided within 15 days after receiving the appeal. If a retrial is granted, the same Ethics Committee can be reorganized or a new Ethics Committee can be organized within 15 days after the decision to hold a retrial was made. If a retrial is to be held, the Committee in charge of the retrial will reinvestigate, determine the result, and inform the informant and examinee of said result within 30 days from the date on which the Committee was convened.
Article 20 (Submission of Official Investigation Report)
  1. 1. The Committee is required to submit a final official investigation report (referred to as a ‘final report’ hereafter) within ten (10) days after the final judgment.
  2. 2. The following contents should be included in the final report:
    1. ① Detailed contents of the misconduct report
    2. ② Explanation of the misconduct in the paper under investigation
    3. ③ Examinee’s role in the research paper and the reason(s) for suspicion
    4. ④ Relevant evidence
    5. ⑤ Information related to defense and/or objection by the informant and/or examinee to the investigation result and the related outcome
    6. ⑥ List of investigators of the Investigation Committee

Chapter 5. Action After Verification of Misconduct

Article 21 (Treatment of Misconduct)
  1. 1. The Committee is able to propose disciplinary action for the person who is found to have participated in misconduct to the President of the Society if a half or more of the committee members attend and at least 2/3 of the attending members agree on the said action.
  2. 2. The President of the Society decides the proper disciplinary action and officially informs the author of the said action in writing.
Article 22 (Disciplinary Measures)

For proposed disciplinary measures, the President of the Society decides the level of the disciplinary measure with respect to the following clauses, and takes disciplinary action against the author. If the President decides that there is a more appropriate disciplinary measure, it can be implemented instead of one of the following measures.

  1. 1. (Caution) Authors are notified of their misconduct and advised to be more careful when writing and submitting their next papers.
  2. 2. (Warning) Authors are notified of their misconduct, and the publication is withdrawn. Authors are advised to be more careful when writing and submitting their next papers.
  3. 3. (Censure) Authors are notified of their misconduct, and the publication is withdrawn. Notice of the said misconduct is posted on the Society’s homepage for one month. For every author at fault, all papers currently under review or awaiting publication are barred from publication, and the main author is prohibited from submitting a paper to the Society for three (3) years.
  4. 4. (Strict Censure) Chairmen of the organizations with which each author is affiliated are notified of the misconduct with official letters, and the publication is withdrawn. Notice of the said misconduct is posted on the Society’s homepage for one month. For every author at fault, all papers currently under review or awaiting publication are barred from publication, and each author is prohibited from submitting a paper to the Society for three (3) years. If the misconduct is one of plagiarism, the President on the Society will provide an official letter of apology to the authors of the original paper.
Article 23 (Storage and Release of Records)
  1. 1. The Editorial Office should keep records regarding preliminary and official investigations and records of any disciplinary measures taken for at least five (5) years after the conclusion of investigation and/or disciplinary action.
  2. 2. A final report can be opened after a judgment has been made, but information regarding the identities of those involved including the informant, investigators, witnesses, and consultants, can be excluded if the release of the said information may disadvantage someone involved.
Article 24 (Detailed Rules of Operation)

Other matters required for the Committee management can be separately regulated through deliberation of the Committee.

Addendum

1. These regulations are implemented as of June 1, 2013.
